Electricity Transmission Rates Filing Requirements Review

The Ontario Energy Board (OEB) is seeking stakeholder input on a proposed update to the OEB’s Filing Requirements for Electricity Transmission Applications - Chapter 1 and Chapter 2 (the Filing Requirements).

The Filing Requirements, originally developed in 2016, will be reviewed as part of this engagement to identify any necessary updates.

The purpose of this engagement is to work with stakeholders to review the proposed updates and determine if any others are needed to:

  • Account for the passage of time
  • Reflect learnings from past transmission revenue requirement proceedings
  • Include any further regulatory process efficiencies that have and can be achieved

The review is intended to ensure the Filing Requirements stay relevant and fit for purpose.

    Rate Framework for Single-Asset Transmitters

    A key focus of the update is to provide guidance on the revenue requirement framework for the growing number of single-asset transmitters now operating in Ontario. Specifically, it aims to clarify the expectations for Custom Incentive Rate-setting (Custom IR) applications required to support filings under this approach.

    Effective Date and Future Developments

    The updated Filing Requirements are proposed to apply to transmission rebasing applications for 2027 rates.

    These updates reflect current legislative and OEB policy frameworks, as well as general regulatory practices. The OEB also recognizes that the transmission sector is evolving. Accordingly, future changes such as the introduction of a Transmission Selection Framework by the Independent Electricity System Operator may necessitate further revisions.

    The OEB intends to review these Filing Requirements every five years to ensure they remain fit for purpose.

    The OEB publishes filing requirements to guide rate-regulated electricity transmitters in preparing transmission applications. This consultation focuses on Chapters 1 and 2 of the OEB’s Filing Requirements for Electricity Transmission Applications.

    • Chapter 1 addresses general procedural matters and outlines the OEB’s expectations for parties involved in transmission revenue requirement and leave-to-construct proceedings.
    • Chapter 2 provides detailed filing requirements for revenue requirement applications.

    Notably, Chapters 1 and 2 have remained unchanged since their initial development in 2016.
